15.12.2021 – Latest news in the labor law field regarding the amendments to the sanctions provided by the Law no. 55/2020 on certain measures of prevention and combating the effects of the COVID-19 pandemic
The Law no. 295/13.12.2021 for the amendment and completion of Law no. 55/2020 on certain measures of prevention and combating the effects of the COVID-19 pandemic was published in the Official Gazette no. 1183 of December 14, 2021.
The new legal provisions include an additional sanctioning regime applicable in case of repeating, within an interval of 15 days from the previous misconduct, the non-compliance with the measures of limiting activity of economic operators, as imposed by the law and/or by the authorities.
More exactly, in such a situation, in addition to the administrative fines between RON 1,000 (approx. EUR 200) and RON 5.000 (approx. EUR 1,000), the authorities also apply the sanction of temporary closure, for 15 days, of the main or secondary offices/headquarters of the economic entity in breach.
Moreover, the law at hand introduces another administrative sanction applicable in case of non-compliance with the measure of temporary suspending activity, in the current pandemic context, ordered according to the currently applicable legal framework.
As such, in addition to the administrative fines ranging between RON 2.000 (approx. EUR 400) and RON 10.000 (approx. EUR 2,000), the authorities also apply the sanction of temporary closure, for 30 days, of the main or secondary offices/headquarters where the economic entity continued to provide the activity officially suspended.
The additional measures introduced by the present law are materialized by display of official notices regarding temporary closure of activity and/or, as case may be, application of seals or other such means of sealing.
