News concerning legal holidays 

Law no. 64/2018 completing par. (1) of Art. 139 of the Labor Code was published within the Official Gazette no. 226/13.03.2018.

The normative act introduces a new legal holiday, during which work shall not be performed, namely the Good Friday (the last day of Friday before Easter).

The provisions of this normative act are applicable starting this year.

News concerning normative acts in matters of workforce

Government Decision no. 80/2018 amending and completing normative acts in matters of workforce was published within the Official Gazette no. 224/13.03.2018. The amendments are mainly justified by the recent amendments brought to the fiscal legislation.

Therefore, the following normative acts were modified:

  • Methodological norms for the application of Law no. 76/2002 regarding unemployment system and stimulation of workforce (approved through GD no. 174/2002).
  • Procedures regarding the access to workforce occupation stimulation measures, financing methods and their implementation instructions (approved through GD no. 377/2002).
  • Methodological norms for the application of Law no. 279/2005 regarding apprenticeship (approved through GD no. 855/2013).
  • Methodological norms for the application of Law no. 355/2013 regarding the performance of internship by higher education graduates (approved through GD no. 473/2014).
  • Methodological norms for the application of Law no. 72/2007 regarding the stimulation of the employment of students (approved through GD no. 726/2007).
  • Methodological norms for the application of Law no. 200/2006 regarding the Guarantee Fund for the payment of salary rights (approved through GD no. 1850/2006).

It can be observed that the recent amendments to the fiscal legislation justify the cancellation or the amendment to different benefits granted to the employers.

Moreover, the sums that are granted in different situations shall be covered by the county (or Bucharest) workforce agency from the unemployment insurance budget, under the terms and conditions provided within the normative acts (e.g. the amount of 1.125 lei/month the employers benefit from, upon request, when concluding an apprenticeship contract, the amount of 1.350 lei/month the employers benefit from, upon request, when concluding an internship contract etc.)

The normative act also contains transitory provisions, that shall be carefully observed, on a case-by-case basis, depending on the benefits in discussion.
